If you and your spouse own an LLC together, the IRS most likely considers your business a partnership. That means you’re required to file a Form 1065 (Partnership Tax Return) — and the deadline is March 15, not April 15.
This catches a lot of married couples off guard. Unlike your personal return (Form 1040), partnership returns are due a full month earlier. And if you miss the deadline without filing an extension, the IRS imposes a penalty of $220 per partner, per month.
For a husband-and-wife partnership, that’s $440 every single month you’re late — with no cap.
The good news? If your return isn’t ready yet, you still have time. Filing an extension (Form 7004) gives you until September 15 to submit your complete return — penalty-free. But the extension itself must be filed before the March 15 deadline.
